Acceptable Use Policy

This Acceptable Use Policy defines appropriate and prohibited uses of CapEngage's AI-powered automation platform and communication services.

1. Purpose

This Acceptable Use Policy ("AUP") establishes guidelines for appropriate use of CapEngage's AI-powered workflow automation platform, communication services, and related tools. By using our Services, you agree to comply with these guidelines.

Violations of this policy may result in account suspension, termination, and legal action where appropriate.

2. Prohibited Activities

2.1 Spam and Unsolicited Communications

You must NOT:

  • Send unsolicited commercial messages (spam) via any channel
  • Send messages to recipients who have not opted in
  • Use purchased or scraped contact lists without consent
  • Harvest or collect contact information without permission
  • Exceed message frequency limits or send bulk spam

2.2 Illegal and Harmful Content

You must NOT use our Services to:

  • Transmit illegal, harmful, or offensive content
  • Promote violence, terrorism, or illegal activities
  • Distribute malware, viruses, or harmful code
  • Engage in fraud, scams, or deceptive practices
  • Violate intellectual property rights of others

2.3 Harassment and Abuse

You must NOT:

  • Harass, threaten, or abuse individuals or groups
  • Engage in cyberbullying or stalking
  • Send threatening or intimidating messages
  • Disclose private information without consent (doxing)

2.4 Security Violations

You must NOT:

  • Attempt to circumvent security measures or authentication
  • Exploit vulnerabilities or perform unauthorized access
  • Use automated tools to abuse our Services
  • Reverse engineer or decompile our platform
  • Inject malicious code or scripts

2.5 AI and Automation Abuse

You must NOT:

  • Use AI to generate deceptive or misleading content
  • Create deepfakes or synthetic media for fraud
  • Automate violations of platform policies
  • Exploit AI vulnerabilities for harmful purposes
  • Generate content that violates laws or regulations

3. Communication Channel Specific Rules

3.1 WhatsApp

Comply with Meta's WhatsApp Business Policy:

  • Obtain explicit opt-in consent before messaging
  • Use approved message templates only
  • Respond to customer messages within 24 hours
  • Allow users to opt-out easily
  • Do not send marketing messages to opted-out users

3.2 Email

Comply with anti-spam laws (CAN-SPAM, GDPR):

  • Include physical mailing address in all emails
  • Provide clear unsubscribe mechanism
  • Honor unsubscribe requests within 10 days
  • Use accurate sender information and subject lines
  • Do not use misleading headers or deceptive content

3.3 SMS

Comply with TCPA and local regulations:

  • Obtain express written consent for marketing SMS
  • Include opt-out instructions in every message
  • Honor opt-out requests immediately
  • Do not send SMS to emergency numbers
  • Respect quiet hours and time zone restrictions

4. Data Protection and Privacy

You must:

  • Obtain proper consent before collecting personal data
  • Comply with applicable data protection laws (GDPR, CCPA)
  • Secure customer data and prevent unauthorized access
  • Provide privacy notices and data handling information
  • Respond to data subject requests appropriately

Do not use our Services to process sensitive data without appropriate security measures and legal basis.

5. Intellectual Property

You must NOT:

  • Infringe on copyrights, trademarks, or patents
  • Use our Services to distribute pirated content
  • Violate third-party terms of service
  • Use our brand or trademarks without permission

You retain ownership of content you create, but grant us license to process it as needed for service delivery.

6. Resource Usage

Fair usage guidelines:

  • Stay within your plan's usage limits
  • Do not abuse free trials or promotional credits
  • Avoid excessive API calls that impact platform performance
  • Do not create multiple accounts to circumvent limits

We reserve the right to throttle or suspend accounts with abusive usage patterns.

7. Enforcement

Violations of this policy may result in:

  • Warning and request to correct behavior
  • Temporary suspension of services
  • Permanent account termination
  • Legal action where appropriate
  • Reporting to law enforcement for illegal activities

We investigate all reported violations and take appropriate action based on severity and intent.
